These Terms of Use ("Terms") govern your access to and use of the mobile games, applications, and website operated by Flying Swan Games Limited ("Flying Swan Games", "we", "us" or "our"), including Solitaire Instant Play (collectively, the "Services"). By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use our Services. If you are under the age of majority in your region, your parent or legal guardian must review and agree to these Terms on your behalf.

2. License & Usage Rules

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use our games for your personal, non-commercial entertainment, subject to these Terms. You agree that you will not:

• Copy, modify, distribute, sell, lease, or publicly display any part of the Services except as expressly permitted;
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of our games, except to the extent permitted by mandatory law;
• Create derivative works based on the Services or their assets;
• Use cheats, exploits, automation, bots, hacks, mods, or unauthorised third-party software to interfere with gameplay or gain unfair advantages;
• Bypass or manipulate in-app purchase mechanics, virtual currency, or advertising systems;
• Use the Services in any way that violates applicable laws or regulations, or infringes the rights of others;
• Upload or transmit viruses, malware, or harmful code through the Services;
• Probe, scan, or test the vulnerability of our systems or networks.

3. User Responsibilities

• You are responsible for your device, your internet connection, and any data charges you incur while using the Services;
• You are responsible for keeping your app store account (Apple ID / Google Account) secure;
• You agree to provide accurate information where requested and to use the Services respectfully and lawfully;
• You are responsible for any activity conducted through your account or device.

4. In-App Purchases

Some of our games offer optional in-app purchases (such as subscriptions, consumables or premium features). All purchases are processed by Apple App Store or Google Play under their respective terms; we do not process payment card data. Prices may change at any time. Unless required by law, purchases are final and non-refundable; refund requests are handled by the applicable app store. Virtual items have no monetary value and cannot be exchanged, sold or transferred outside the game.

5. Advertising

Our free or low-cost games are supported by advertising served through third-party networks (including Google AdMob and AppLovin MAX). By using the Services you agree that such advertising may be displayed. Your data rights and opt-out options are described in our Privacy Policy.

6. Intellectual Property

All rights, title and interest in the Services — including game code, artwork, characters, music, sounds, text, trademarks and logos — are owned by Flying Swan Games Limited or its licensors and are protected by copyright, trademark and other intellectual property laws. Except for the limited license granted in Section 2, no rights are transferred to you. Any feedback or suggestions you send us may be used freely by us without obligation or compensation.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. GAMEPLAY OUTCOMES ARE FOR ENTERTAINMENT ONLY.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLYING SWAN GAMES LIMITED AND ITS DIRECTORS, EMPLOYEES AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD 10, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Indemnification

You agree to indemnify and hold harmless Flying Swan Games Limited from any claims, damages, losses and expenses arising from your breach of these Terms or your misuse of the Services.

10. Changes, Suspension & Termination

• Service changes: we may update, modify, add or remove game features, content, or pricing at any time without notice;
• Term updates: we may revise these Terms from time to time; continued use after changes take effect constitutes acceptance. Material changes will be indicated by a new "Last updated" date;
• Suspension & termination: we may suspend or terminate your access if you breach these Terms, engage in abusive or illegal conduct, or where required by law. We may also discontinue a game or service entirely, with reasonable notice where practicable;
• Effect of termination: upon termination, your license ends; sections that by their nature should survive (including intellectual property, disclaimers and liability limits) will survive.

11. Third-Party Services & Links

The Services may contain links to third-party websites or integrate third-party services (such as app stores, ad networks and analytics providers). We are not responsible for their content, policies or practices. Please review their terms and privacy policies separately.

12. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR, except where mandatory consumer protection law in your country of residence provides otherwise.
